Law Professors et al. as amici curiae hereby move for leave to enlarge the list of amici curiae on the Brief in Support of Defendant Jonathan Pollard's Motion for Resentencing Pursuant to 28 U.S.C. § 2255 and in Opposition to the Government's Motion to Dismiss Pursuant to the Statute of Limitations.
On September 20, 2000, counsel for defendant filed a motion for resentencing pursuant to 28 U.S.C. § 2255.
On November 28, 2000, the government filed a motion to dismiss defendant's § 2255 motion as barred by the statute of limitations.
On December 28, 2000, Law Professors et al. as amici curiae filed an unopposed motion seeking leave to file an accompanying amicus brief in support of defendant's motion for resentencing and in opposition to the government's motion to dismiss.
All three motions are currently pending before the Court.
Attached hereto as Exhibit A is a copy of the list of amici curiae listed on the brief attached to the motion filed December 28, 2000.
Since December 28, 2000, additional persons have indicated that they wish to have their names added to the list of amici on the amicus brief. Attached hereto as Exhibit B is a list of the persons who wish to be added.
We therefore respectfully request that the Court grant leave to enlarge the list of amici curiae by adding the supplemental list of amici (Ex. B) to the original list submitted to the Court on December 28, 2000 (Ex. A).
We respectfully request that the Court waive the requirement under the Local Rules that a supporting statement of specific points of law and authority be submitted herewith.
A proposed Order is attached.
